Hello all! I’ve been teaching MS theatre 6-8th for about four years, but this is a first. To begin, let me give context. TLDR will be at the bottom. At the beginning of the year, I was told I would have 2, Tier Three behavior students on my roster for my first period of 6th grade theatre. Not a problem. First day comes, and student A gets pulled out of my class after 20 minutes. He hasn’t been back except with an adult maybe five times. That’s not an issue. Student B is where the issue comes in. Student B was very very disruptive, wouldn’t keep their hands to themself, would constantly take stuff off my desk, and was causing problems for other teachers. They reevaluated, realized they were probably more life skills than behavior, and moved them into the behavior room nearly full time. Again, not a problem. However, unlike student A, they changed students B’s schedule in Skyward. They’re officially not on my roster. Recently, they’ve started reintroducing student A and B back into gen pop. They’re both coming to my first period, and they’ve both been coming with their own adult. There was one day when they both came with only one, and then student A hasn’t been back since. Student B continued coming with an aide, and then one day the aide explained that they’re gonna start leaving him by himself after the first ten minutes. The started it that day because they were short handed in the behavior room, the aide admitted. Then, he didn’t come back for like a week. Today, a different aide just opens the door and drops them. She doesn’t stay for the ten minutes like she’s supposed to. They don’t cause any problems, but she doesn’t come to get them until a minute before the bell. The one time I tried to tell behavior that they weren’t on my roster, I was told that it was fine, that they’re only scheduled to be in behavior so they can get the extra support, but they’re still in my class. I’m worried about the situation this puts me in legally. Especially since, we can’t access BIP/IEP paperwork if that student isn’t on our roster. A new set is only sent out when there is an ARD, and they’re only sent to the teachers of record. Am I liable if something goes haywire, and I don’t know the updated PIB?
